1. Acceptance of Terms
By accessing and using BulkPesa ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service govern your use of our M-Pesa bulk payment platform.
If you do not agree to abide by the above, please do not use this service. These terms comply with Kenyan law and Safaricom M-Pesa regulations.
2. Service Description
BulkPesa is a bulk payment platform that enables users to send money to multiple M-Pesa recipients simultaneously. Our services include:
- CSV file upload and validation for bulk payments
- Contact-based payment selection
- Single payment processing
- Real-time transaction tracking and status updates
- Payment receipt generation and PDF download
3. Eligibility and Registration
3.1 Age Requirement
You must be at least 18 years old to use BulkPesa. By using our service, you represent that you meet this age requirement.
3.2 M-Pesa Account
You must have a valid Safaricom M-Pesa account to use our services. You are responsible for maintaining the security of your M-Pesa account.
3.3 Legal Compliance
You must comply with all applicable laws and regulations when using BulkPesa, including but not limited to anti-money laundering (AML) and counter-terrorism financing (CTF) requirements.
4. Acceptable Use
4.1 Permitted Uses
- Legitimate business payments (salaries, vendor payments, etc.)
- Personal transfers to family and friends
- Charity and donation distributions
- Event prize distributions
4.2 Prohibited Uses
- Money laundering or terrorist financing
- Fraudulent or illegal activities
- Gambling or betting transactions
- Transactions to sanctioned individuals or entities
- Spam or unsolicited commercial communications
- Violation of any applicable laws or regulations
5. Fees and Charges
5.1 Fee Structure
- Transaction Fee: KES 10 per recipient
- Commission: 5% of total amount to recipients
- Total Customer Payment: Amount to Recipients + Transaction Fees + Commission
5.2 Payment Terms
All fees are charged upfront via M-Pesa STK Push before processing begins. Fees are non-refundable except in cases of service failure.
5.3 Fee Changes
We reserve the right to modify our fee structure with 30 days advance notice. Continued use of the service after fee changes constitutes acceptance.
6. Transaction Processing
6.1 Processing Times
Transactions are typically processed within 2 minutes. Processing times may vary based on M-Pesa system availability and network conditions.
6.2 Transaction Limits
- Minimum payment: KES 10 per recipient
- Maximum payment: Subject to M-Pesa daily limits
- Maximum recipients: 1,000 per transaction
6.3 Failed Transactions
We will attempt to retry failed transactions up to 3 times. If a transaction fails after all retry attempts, we will notify you and the funds will be handled according to our refund policy.
7. Refunds and Disputes
7.1 Refund Policy
- Successful transactions are generally non-refundable
- Failed transactions due to service errors will be refunded
- Partial refunds may be issued for partially successful bulk payments
- Refund requests must be made within 30 days
7.2 Dispute Resolution
Disputes will be resolved through good faith negotiation. If unresolved, disputes may be referred to arbitration under Kenyan law.
8. Data and Privacy
Your use of BulkPesa is subject to our Privacy Policy, which forms an integral part of these Terms. By using our service, you consent to our data practices as described in the Privacy Policy.
You are responsible for ensuring you have proper consent from recipients before processing payments to their phone numbers.
9. Intellectual Property
BulkPesa and all related content, features, and functionality are owned by BulkPesa and are protected by Kenyan and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works of our service without explicit written permission.
10. Disclaimers and Limitations
10.1 Service Availability
We strive for 99.9% uptime but cannot guarantee uninterrupted service. We are not liable for service interruptions due to maintenance, M-Pesa system issues, or force majeure events.
10.2 Third-Party Dependencies
Our service depends on Safaricom M-Pesa infrastructure. We are not liable for issues arising from M-Pesa system failures or maintenance.
10.3 Limitation of Liability
To the maximum extent permitted by law, BulkPesa's liability is limited to the fees paid for the specific transaction in question. We are not liable for indirect, incidental, or consequential damages.
11. Account Security
- You are responsible for maintaining the security of your M-Pesa account
- Immediately report any unauthorized transactions
- Do not share your M-Pesa PIN or account details
- Use secure networks when accessing BulkPesa
- Log out from shared devices
12. Compliance and Monitoring
We reserve the right to monitor transactions for compliance with these terms and applicable laws. We may:
- Suspend or terminate accounts for violations
- Report suspicious activities to authorities
- Request additional documentation for verification
- Implement transaction limits or restrictions
13. Termination
13.1 By You
You may stop using BulkPesa at any time. Termination does not affect completed transactions or outstanding obligations.
13.2 By Us
We may terminate or suspend your access immediately for violations of these terms, illegal activities, or to comply with legal requirements.
14. Changes to Terms
We may modify these Terms of Service at any time. Material changes will be communicated via email or website notice. Continued use after changes constitutes acceptance of the updated terms.
15. Governing Law
These Terms are governed by the laws of the Republic of Kenya. Any disputes will be resolved in Kenyan courts or through arbitration as specified herein.

17. Severability
